Terms of Service

1. Acceptance

By using Apex Studio, operated by Axon Labs LLC, you agree to these Terms.

2. Service Description

Apex Studio provides AI-powered content generation including video, voice, image, avatar, commercial, and clip generation. All output is generated by artificial intelligence models.

3. Content Ownership

You retain ownership of all content you upload and all content generated for you. On paid plans, generated content may be used commercially without restriction, subject to the AI Content Compliance section below.

4. AI Content Compliance

All content generated by Apex Studio is AI-generated. You are responsible for:

• Platform disclosure:Complying with each platform's AI content disclosure requirements (TikTok, Meta, YouTube, X, etc.) when publishing AI-generated content. See our AI Disclosure Guide.
• No fake testimonials: You may NOT use AI avatars to present as real customers giving genuine product testimonials or endorsements. This violates FTC regulations (penalties up to $51,744 per incident) and our Terms.
• Right of publicity: You may NOT use the Service to create content depicting real, identifiable individuals without their explicit written consent.
• Regulatory compliance: You are responsible for complying with all applicable laws in your jurisdiction regarding AI-generated content, including but not limited to the EU AI Act, FTC guidelines, and state-level disclosure laws.

Apex Studio provides disclosure tools (AI labels, C2PA metadata) to help you comply, but compliance is ultimately your responsibility.

5. Acceptable Use

You may not use the Service to:

• Generate deepfakes of real people without their consent
• Create fake reviews, testimonials, or endorsements using AI avatars
• Generate illegal, harmful, or deceptive content
• Produce content that violates platform terms of service
• Generate spam or misleading advertising
• Create content that infringes on intellectual property rights

Violation of these terms may result in immediate account termination without refund.

6. Billing & Credits

Paid subscriptions are billed monthly or annually via Stripe. Cancel anytime from your dashboard — you retain access until the end of your billing period. Unused credits roll over month-to-month on active subscriptions. Credits expire 30 days after subscription cancellation.

Auto top-up charges (if enabled) use your saved payment method. You can disable auto top-up at any time from Settings.

7. Refunds & Satisfaction

Failed generations are automatically refunded. If you are unsatisfied with output quality, rate it in your dashboard — Business+ plans include free regenerations for low-rated outputs.

8. Indemnification

You agree to indemnify and hold harmless Axon Labs LLC from any claims, damages, or expenses arising from your use of AI-generated content, including but not limited to claims related to false advertising, right of publicity violations, or regulatory non-compliance.

9. Limitation of Liability

The Service is provided "as is" without warranties. Axon Labs LLC is not liable for any damages arising from the use of AI-generated content, including but not limited to platform penalties, regulatory fines, or business losses resulting from AI content.
