AI content regulations are evolving rapidly. This guide covers major platforms and regulations as of March 2026. You are responsible for compliance in your jurisdiction. When in doubt, disclose.

Platform Requirements

Each platform has its own rules for AI-generated content. Here's what you need to know before publishing.

TikTok

  • Mandatory "AI-generated content" toggle when uploading realistic AI content.
  • TikTok Shop: NO filters that exaggerate product appearance or results.
  • TikTok actively scans and removes unlabeled AI content — 2.3M videos removed Q1 2026 (180% increase YoY).

Non-compliance risk: Strikes, content removal, account ban.

Tip: Always enable the AI disclosure toggle before publishing. For TikTok Shop product ads, show the product naturally without enhancement filters.

Meta (Instagram & Facebook)

  • "AI Info" label required on realistic AI-generated or AI-modified content.
  • Meta auto-detects C2PA metadata and applies labels automatically.
  • Ads with AI-generated faces must be disclosed.

Non-compliance risk: Downranking, content removal, ad account restrictions.

YouTube

  • "Altered or synthetic content" disclosure required in YouTube Studio upload flow.

Tip: When uploading to YouTube Studio, check the "Altered content" box in the disclosure section. Add a note in your video description.

X (Twitter)

  • "Made with AI" label for synthetic or manipulated media.
  • Expanding enforcement for political and sensitive content.

Non-compliance risk: Up to 90-day revenue suspension for unlabeled AI content on sensitive topics.

Tip: Add the AI label when posting. X is expanding automated detection — proactive disclosure protects your account.

Google Ads

  • Google encourages AI in ad creation but requires governance guardrails.
  • Ads must not be deceptive regardless of how they were created.
  • Political ads with synthetic content must be disclosed.

Non-compliance risk: Policy violations, ad disapproval, account suspension.

Tip: Google is AI-friendly but deception is still against policy. Ensure your ads represent your product accurately.


Legal Regulations

Government regulations that apply to AI-generated content used in advertising and media.

FTC (United States)

Deadline: NOW — Active enforcement

AI-generated testimonials and endorsements must be clearly disclosed. Cannot use AI avatars to present as real customers giving genuine testimonials.

Penalty: Up to $51,744 per incident.

EU AI Act

Deadline: August 2026

Mandatory machine-readable AND human-visible labels on ALL AI-generated content. Applies to any content that reaches EU audiences.

Penalty: Up to 15M EUR or 3% of global annual revenue.

NY Synthetic Performer Disclosure

Deadline: June 2026

"Conspicuous" disclosure when advertisements feature synthetic (AI-generated) performers.

Penalty: State Attorney General enforcement.

State Deepfake Laws (46 states)

Deadline: Varies — ongoing

Various disclosure and consent requirements for synthetic media. Most states require disclosure when AI-generated content depicts real or realistic people.

Penalty: State-level civil and criminal penalties.
